Appellee moves the court for an order certifying this cause to the Supreme Court for the reason that the decision and judgment of this court is in conflict with the decision and judgment of the Court of Appeals of the Third Appellate District in the case of Esmonde v. Lima Locomotive Works, 51 Ohio App. 454,1 N.E.2d 633.

This motion requires an examination of the constitutional provision and of the case with which it is claimed the decision of this court is in conflict. Section 6, Article IV of the Constitution provides:
