Kason Industries, Inc., a New York corporation with its principal place of business in Georgia, has manufactured and distributed commercial refrigeration and food services equipment hardware since 1928. Kason brought claims for both monetary and injunc-tive relief against Component Hardware Group, Inc. (CHG) and Peachtree Distributing, Inc. under § 43(a) of the Lanham Act, 15 U.S.C. § 1125(a), the Georgia Fair Business Practices Act, O.C.G.A. § 10-1-390 et seq., and state common-law claims of trademark infringement and unfair competition.
