EVANS, District Judge.
On the 5th day of December, 1898, the co-partnership firm of Simonson, Whiieson & Co. made a general assignment for the benefit of its creditors to L. Comingor. The latter accepted the trust, and was promptly qualified to act by the Jefferson county court, before which he executed the bond and took the oath required by law, and entered upon the discharge of his duties. On the 8th day of December, 1898, the trustee brought a suit in the Jefferson circuit court for the settlement of Ms trust; seeking, also, the advice and judgment of the court as to the proper disposition…
