This is a suit in equity instituted by J. G. Baldwin and numerous other persons, firms, corporations, citizens and taxpayers of the City of Martinsburg, against the City of Martinsburg, a municipal corporation, Carl Wellinger, its Mayor, and J. Frank Seibert, Recorder, the purpose of which is to obtain a decree declaring, invalid certain ordinances adopted by the council of the City of Martins-burg, imposing a privilege tax on certain classified businesses and occupations carried on in said city; and providing for the assessment and collection of such taxes, and penalties for the…
