This action arises out of a public construction contract entered into between defendant Cresta Construction, Inc. (“Cresta”) and third-party defendant, Commonwealth of Massachusetts. Plaintiff, Jim Walsh Plumbing Co., Inc. (“Walsh”), pursuant to G.L.c. 149, §29, asserts that Cresta owes it $60,556 for work performed under the parties’ subcontract. In response to Walsh’s claim, Cresta impleaded the Commonwealth as a third-party defendant and asserted various counterclaims against Walsh.
