This matter came before the Court on defendant’s Motion to Stay Proceedings Pending Arbitration or To Dismiss (July 19, 1983). Defendant asserts that a stay is appropriate under section 3 of the Federal Arbitration Act, 9 U.S.C. § 3, because plaintiff’s claims arise out of or relate to a brokerage account subject to a contractual agreement between the parties to arbitrate any such controversies.
