This is a certiorari to the court of common pleas of the county of Ross. The record shows that on June 26, 1841, the plaintiffs in error recovered a judgment against the defendants, in the court of common pleas for Ross county, for 11,736.77, besides costs of suit. On the 14th day of July of the same year, a writ of ft. fa. was issued and put into the hands of the sheriff, and which writ was returned at the November term of said court of common pleas, 1841. The questions arising in this case are of great •interest, inasmuch as the rights of the state, of a county, and of ■individuals, members of an incorporated company, are involved.
