After Thomas Flewellyn initiated foreclosure proceedings on *487Robert Elliott’s property, Elliott filed a complaint seeking a temporary restraining order, an interlocutory injunction, a declaratory judgment' on the loan agreement, and damages and attorney fees for various torts alleged in relation to the foreclosure. The trial court granted Elliott’s motion for a temporary restraining order. Flewellyn moved to dissolve the temporary restraining order and during the hearing on June 5, 1984 (the date of the foreclosure sale), an order was prepared in which the parties agreed that…
