This suit was instituted in the district court of Young county by E. C. Stovall, appellant herein, against appellee, for $3,250, which plaintiff claimed was due him as a balance on rents, which the defendant, the Texas Company, was owing to him under and by virtue of a certain oil and gas lease which it held on plaintiff's lands. This lease was dated June 9, 1917, and was executed by plaintiff, as attorney in fact for his father, C. C. Stovall; said land amounting to 440 acres.
