In a special proceeding for a judgment declaring inter alla that the special assessment placed on petitioners’ real property for grading and paving of certain streets is illegal and that the apportionment of the assessment is unconstitutional as applied to said property, petitioners appeal from a judgment of the Supreme Court, Nassau County, dated September 18, 1972 and made after a hearing, which dismissed the petition.
