Defendant was prosecuted on information charging that he did feloniously attempt to steal from the person of one James Teal $1.15, in the lawful currency of the United States.

Defendant was tried, convicted, and sentenced to five years at hard labor, under the provisions of Act No. 133 of 1904. Defendant’s appeal was taken on two bills of exception, which contained the same ground of objection presented in a motion for a new trial and a motion in arrest of judgment, to the effect that the case was never properly allotted as required by the Constitution and rules of court, and therefore the…
