On a Sunday afternoon in June, 1940, near his residence in that portion of the city of Jellico lying in Whitley county, Kentucky, the appellant and defendant below, Bill Smiddy, murdered his wife, then seventeen years of age, by stabbing her with a knife upon various parts of her body about sixteen times, several of which wounds Avere fatal — particularly the one severing the jugular Amin, and the one in or near the heart of his victim.
