This was a suit brought before a justice of the peace in the name of the p.eople of the town of Antioch, against appellant, under the provisions of section 74 of chapter 121, entitled “Roads,” (2 Starr & Cur. Stat. 1896, p. 3585,) to recover the penalty of not less than three dollars and not more than ten dollars provided by section 71 to be forfeited for obstructing a public road by building a fence therein.
