This was an appeal from a justice of the peace to the circuit court. The appeal bond was filed with the clerk, and the appeal perfected in that court. No summons was served on appellee, nor was there a summons and alias summons issued and returned not found, nor did appellee enter his appearance ten days before the commencement of the term, but his appearance was entered at the time the motion ivas entered to dismiss the appeal.
