delivered the opinion of the court.

June 21,1930, plaintiff, as landlord, caused judgment by confession to be entered against the defendant, as tenant, for $7,616.68, which included $500 attorney’s fees. September 8, 1930, the defendant filed a written motion, supported by a petition and affidavit to vacate and open up the judgment and for leave to defend. The matter was continued from time to time and the defendant given leave to file two additional affidavits in support of his motion, and on January 2, 1931, the motion came on for hearing and was denied.…
