This suit is over two real estate brokers’ commissions, one in the sum of $18-,000, claimed by Ed Mulligan, and the other in the sum of $5,000, claimed by Geo. W. Allen, from the Omar Gasoline Company.

The evidence shows that the Omar Gasoline Company was a trust association, acting under a declaration of trust, with seven trustees, who were authorized to elect a chairman of the board of trustees, a president, one or more vice presidents, a secretary, a treasurer, and “such other officers as they may deem necessary for the proper management of the trust.” The only trustee residing in Wichita…
