Silas Richardson, the appellant, was tried and convicted by a jury at the regular September, 1928, term of the circuit court of Hancock county for the crime of murder, and sentenced by the court to suffer the death penalty, and appeals to this court.

The appellant was convicted in the court below of the murder of John Damberino.
