REID, Judge.

Plaintiff, Walter Davenport, prosecutes this appeal from a judgment dismissing his suit to recover workmen’s compensation benefits against defendant, Kaiser Aluminum and Chemical Corporation. Plaintiff alleges he is totally and permanently disabled as a result of having sustained an injury to his back which caused the aggravation of a pre-existing back ailment, following an accident which occurred on May 16, 1960, while he was performing his duties as a common laborer in the course and scope of his employment with Defendant Corporation.
