1Opinion of the CourtTerrell, J.

Rosaria Dina sued the Seaboard Air Line Railway Company for the wrongful death of her husband. To the declaration of the plaintiff, defendant entered the plea of the general issue and contributory negligence. The ease was tried on the issue made by these pleas, -and the jury found for the defendant. Motion for new trial was overruled and plaintiff took writ of error.

The first assignment of error is predicated on the order of the trial court striking certain allegations of the declaration as to age of deceased and as to mental pain and suffering of the plaintiff.
