This was a suit in ejectment, brought by Eugene H. Whitham, against the Lake Erie and Western Railroad Company, to recover a strip of land forty or fifty feet in width and nine hundred and sixty-five feet long, lying between the north line of blocks 13 and 14, in the village of Rankin, Vermilion county, and the north line of the south-east quarter of section 11, township 23, north of range 14, west, being a part of the land claimed by the defendant as its right of way.
