MEMORANDUM OPINION ON AZTE-CAMERICA BANK’S MOTION TO VACATE THE ORDERS OF SEPTEMBER 11, 2008

On August 21, 2007, Aztec Supply Corporation (“Debtor”) filed its voluntary petition for relief under Chapter 11 of the Bankruptcy Code. AztecAmerica Bank (the “Bank”) was the only secured creditor of Debtor and asserted a first priority security interest on all of Debtor’s assets.
