The plaintiff is the owner of real property abutting on Jamaica avenue, in the borough of Queens, city of New York, on which avenue the defendant maintains and operates an elevated railroad. The action is to recover damages for loss of easement rights of air, light and access, occasioned by the structure on which the defendant operates its railroad. In the complaint it is alleged that such operation and maintenance have continued since the 3d day of July, 1918, while the defendant, in its answer, set forth that the structure was commenced on the 3d day of October, 1916, and was substantially…
