CHATFIELD, District Judge.
The complainants have brought action against two defendants who are making and selling carbureters containing the same elements as are described in complainant’s Schebler patent, No. 806,434, issued December 5, 1905, upon an application filed October 30, 1903. The defendants’ carbureters are both almost exact copies of the patented device, and no question of infringement, apart from that of validity,. exists as the record now stands.
