Memorandum: This wrongful death action arose from the prisoner takeover of a portion of the Attica Correctional Facility in September, 1971. Claimant’s intestate is alleged to have died as a result of the retaking of the institution by the State (see Jones v State of New York, 33 NY2d 275). The State appeals from an order which directs it to furnish to claimant the records of the New York State Commission on Attica (McKay Commission) for inspection and copying, and to allow claimant to inspect…
