Appeal from a judgment of the County Court of Warren County (Moynihan, Jr., J.), rendered March 27, 1990, upon a verdict convicting defendant of the crimes of murder in the second degree and attempted murder in the second degree.

On September 6, 1989, defendant entered the residence of his estranged wife, Nicole Layer, in the Town of Queensbury, Warren County, while carrying a loaded .20-gauge shotgun and a container filled with gasoline.
