Plaintiff, the conductor of a freight train operated by the defendant railroad company in the state of California, was seriously injured by stepping from the steps of the caboose attached to said train while the same was standing on a bridge near the station of Omira. In stepping from the caboose, plaintiff was precipitated to the ground beneath the bridge, a distance of approximately 18 feet. He brought this action to recover damages for the injury sustained, and as grounds therefor alleged that defendant negligently and carelessly constructed said 'bridge only the width of the railroad…
