This cause came on for hearing upon the plaintiffs’ motion for summary judgment. The suit was filed as a class action by Jerome and Louise Mathis, husband and wife, on behalf of themselves and all others similarly situated. The suit challenges the constitutionality of Florida Statute 222.06 insofar as it authorizes the sheriff of Dade County, or his subordinates in the civil process bureau of the Dade County Public Safety Department, to take the property of a judgment debtor pursuant to a writ of execution without providing said judgment debtor an opportunity for a…
