This was an action of debt oh a single bill, given by plaintiff in errdr, defendant below, to defendant in error, for 2,310 dollars, on what the partiés went to trial, On the plea of payment, with leave to give the special matter in evidence, Under this plea, the defendant gave notice of special matter, which set out the defence, the consideration for which the bill was given, and the failure of that consideration.
