On October 18, 1952, Nathaniel Ferebee and Elsie Nichols, the alleged wife of Benson Nichols, were riding in the latter’s automobile when it collided with an automobile owned by plaintiff, Harry C. Coureas, and driven by his son. Thereafter plaintiff instituted an action against Ferebee, Elsie and Benson Nichols to recover for damage to his automobile, which action was dismissed as to Benson Nichols but the plaintiff recovered a judgment for $1,500 against Elsie Nichols and Ferebee.
