Cora Hender brought suit against the Potomac Electric Power Company, Washington Gaslight Company, and the District of Columbia, alleging that she stepped into an open box in the sidewalk on Eight street, Washington, left uncovered through the negligence of the defendants, and that her foot was thereby injured without fault on her part. Each of the defendants pleaded not guilty, and issue; was joined on their pleas. At the close of the evidence on behalf of plaintiff, defendants separately moved for a directed verdict.
