This action is brought to foreclose two mortgages. The facts are somewhat complicated, and, so far as they are pertinent to the questions involved, are as follows: On April 6, 1870, one James McNamara, residing in the town of Redfield, county of Oswego, N. Y., was the owner of 69 acres of land, in said town free. and clear of all incumbrance. On said 6th day of April, 1870, Daniel" G. D'orrance and wife, of Oneida Castle, Oneida county, N.
