On the 20th of September, 1885, there was returned and filed in department 11 of the Superior Court of the city and county of San Francisco an indictment for felony against the petitioner in tb#s case found by the grand jury. After the indictment was filed, the presiding judge of the Superior Court assigned it to department 1 of the said court for trial. The petitioner was afterwards arrested on a bench-warrant issued upon the indictment, and was brought into court for arraignment.
