*469 In this wrongful death action filed against the City of Conyers ("the City"), Steve Wilkins appeals from the trial court's order dismissing his lawsuit as a sanction for the spoilation of evidence pertinent to his claims. Because we conclude that the trial court abused its discretion in dismissing the complaint, we reverse and remand this case to the trial court for proceedings consistent with this opinion.
