This is a suit by the appellant against the appellee for breach of a contract by which the defendant agreed to furnish a saAvmill, all of his standing timber, and the use of certain teams, wagons, etc., in consideration that plaintiff would cut the timber, furnish drivers, labor, etc., and manufacture the lumber in a workmanlike manner — said lumber to be the property of plaintiff and defendant in equal shares, and the plaintiff to purchase defendant’s part thereof at $9 per 1,000 feet.
