The indictment against the defendant contained three counts. Count 2 was abandoned by the solicitor-general in open court. Count 1 charged that the defendant did unlawfully and with force and arms unlawfully keep, maintain, employ, and carry on a certain scheme and device for the hazarding of money and other valuable thing, said scheme and device being known as a slot machine.
