The defendant stands accused of multiple counts of assault (Penal Law § 120.00 [1]); obstruction of breathing (Penal Law § 121.11 [a]); menacing (Penal Law § 120.15); aggravated harassment (Penal Law § 240.30 [4]); and harassment (Penal Law § 240.26 [1]). By motion, dated April 15, 2015, the defendant seeks disclosure of information relating to the complainant’s alleged mental health history or, alternatively, the issuance of a judicial subpoena for the information sought.
