— Appellant, Darrell K. Barton, filed his application seeking compensation for disability benefits, permanent partial impairment and medical expenses resulting from an accident arising out of and in the course of his employment with appellee, Warner Gear Division of Borg-Warner Corporation, Muncie, Indiana.. Appellant asserts that on October 5, 1961, while in the course of his employment, he dropped a railroad tie on his left leg and foot, causing him to lose his first and second toenails on his left foot, and that he fell backwards, striking his back on a pile of railroad ties.
