The defendant in this case, Oliver Pierson, was indicted, jointly with one Will Jackson, for the murder of Eobert Henderson, by shooting him with a pistol; was tried separately, convicted of murder in the second degree, and sentenced to the penitentiary for the term of ten years. The bill of exceptions purports to set out “substantially all the evidence in the case,” and shows that the parties were all negroes, and that the difficulty occurred on Sunday afternoon during the summer of 1892, at a country church on the railroad…

The defendant was tried and convicted of murder in the second degree. The first exception is to the action of the court in excusing the juror Cowart, who had been drawn and summoned on the special venire. When his name was called, he stated to the court, that he was a member of the police of the city of Troy, and on active duty, and asked to be excused from service as a juror. The court excused him, and the defendant excepted. Section 4335 of the Criminal Code is as follows: “The court may excuse from service any person summoned as a juror, if he is disqualified, or exempt, or for any other…
