This matter comes before the court on defendant’s motion for a new trial. A motion for judgment n. o. v. was abandoned. The jury returned a verdict in favor of Allen Peffer, the minor-plaintiff, for $14,900 and $5,200 for his widowed mother in her own right. Their respective claims for damages arose out of an accident which occurred when the minor’s right hand was caught in the escalator maintained in defendant’s store and as a result thereof the index, third and fourth fingers had to be amputated at the third joint.
