OPINION

BROWN, Commissioner.

This is an appeal from convictions for murder with malice under the former penal code. Appellants were jointly tried before a jury which assessed punishment for each man at life in the Texas Department of Corrections.

The record reflects that the killing took place at the home of Mrs. Vallie Baugh, the ninety-two year old mother of appellant Baugh, and grandmother of appellant Bal-dridge. It seems that a disagreement had arisen over the exact location of the property line between Mrs. Baugh’s property and the adjoining homesite of Mrs. Helen Williams Cassel. The…
