Plaintiffs in error, James Gillespie and Charles Dunn, were convicted in the circuit court of Johnson county of the burglary of a house- owned by William H. Craig, and the larceny thérefrom of a quantity of wheat'.

Several of the questions raised by the assignment of errors and the argument of counsel relate to rulings of the court prior to the November term, 1897, at which the trial was had.
