*524The following is Judge Taft’s opinion, delivered at the December Special Term:

Taft, J.

These four actions are each founded on a policy of insurance for $2,500, on the theater in Louisville, formerly owned by the plaintiff, but owned, when the original policies of which these are renewals were issued, by Geo. F. Fuller.

The petitions are alike, and severally set out that the plaintiff' sold the theater to Geo. F. Fuller, reserving a small rent of $100 per annum, and a lien for $26,250 of balance of the purchase money; and that the deed of transfer also contained a clause providing that Fuller…
