Appeal from a judgment of the Supreme Court (Lahtinen, J.), entered January 3, 2000 in Franklin County, which denied petitioner’s application for a writ of habeas corpus, in a proceeding pursuant to CPLR article 70, without a hearing.

Petitioner, having been convicted of two counts of murder in the second degree and one count of criminal possession of a weapon in the second degree, commenced this habeas corpus proceeding challenging the sufficiency of the indictment, as well as the evidence leading to the second degree murder convictions, and alleging ineffective assistance of counsel.…
