The Dunkirk High School of the city of Dunkirk, county of Chautauqua, has a football team which during the football season plays in competition with the teams of other, high schools and preparatory institutions. In 1928 the team met with certain reverses which touched the pride of local admirers. The playing ■of the team was severely criticized by the Dunkirk Evening Observer, published by the defendant, a paper having considerable circulation throughout the State.
