On March 2, 1927, the grand jury of Monroe County returned an indictment against the defendant-appellant, accusing him of the crime of (statutory) rape, committed January 6, 1927, upon one Thelma Ferguson, who was then about 13 years of age. To this eharg'e, the defendant pleaded not guilty. Accordingly, the cause was called for trial March 17th of the same year, and the jury returned a verdict of guilty.
