MEMORANDUM AND ORDER
MacLAUGHLIN, District Judge.
This matter is before the Court on defendants’ motion to dismiss. The motion will be denied.
FACTS
Plaintiff Network Professionals, Inc. sells air and water filtration systems though independent distributors; the independent distributors in turn recruit sub-distributors. In 1990, plaintiff produced a training videotape entitled “The Solution,” which was used to recruit sub-distributors; shortly thereafter, plaintiff created a derivative videotape entitled “The Solution for the 90’s.” Plaintiff distributes the derivative videotape nationwide to…
