Appeal from a judgment of the County Court of Franklin County (Main, Jr., J.), rendered July 14, 1997, convicting defendant upon his plea of guilty of the crime of driving while intoxicated.
Defendant’s guilty plea to the crime of felony driving while intoxicated was entered following negotiations wherein the District Attorney agreed to recommend that County Court follow the sentencing recommendation of the presentence report. *662The presentence report recommended that defendant “be sentenced to a period of incarceration.
