This is a writ of error to the Supreme Court. At tlie close of defendant’s case, a verdict was rendered, by direction of the court, in favor of defendant.

The action was brought to recover damages for personal injury sustained by the plaintiff, which, lie alleges, was caused by tlie sudden and violent jerking of a passenger train of defendant in the act of starting, while plaintiff was attempting to alight therefrom, at Red Bank, New Jersey, at about one-fifteen o’clock in the morning.
