McGOWAN, Senior Circuit Judge:

Appellant Salisbury, a correspondent and editor with the New York Times brought suit in the District Court seeking the release of certain documents under the Freedom of Information Act. He also alleged, as a separate cause of action, that the National Security Agency (NSA) and the Secretary of Defense had violated his rights under the first and fourth amendments. As a remedy for the latter, he sought damages under the Federal Tort Claims Act and injunctive relief.
