The material portions of the petition of J. B. Cameron against the Mayor and Council of the Town of Eastman are as follows: During the years 1895, 1896, and 1897, he was the clerk and treasurer of said town. It was his *111duty to receive and pay out all money coining to the mayor and council from every source. He was entitled, under the charter and ordinances of the town, to commissions of 2-|- per cent, on all sums received and paid out by him.
